Indian woman gets relief in divorce case in Australia
New Delhi, Jan 28 : An Indian woman will not have to go to Australia, where her estranged husband has filed a divorce case, as a court here Wednesday granted relief to her.
Civil Judge Shivali Sharma ruled in favour of the woman who had approached the court after receiving summons from the Federal Court of Australia, Melbourne.
The Australian court had sought her presence on Feb 3, and said it will pass an ex-parte order if she did not appear before it.
The divorce proceedings were initiated by her husband, who went abroad after allegedly deserting her within 10 days of their marriage.
In the Delhi court, the woman objected to her husband's move to file a divorce case against her outside the country since they were married in Delhi Nov 24, 2007, as per Hindu rites.
The court here also ordered that a copy of its order be served to the petitioner's non-resident Indian husband.
