NRI files SC contempt case against AMRI

Kolkata, Dec 20 : A case for "contempt" of Supreme Court was filed Friday by NRI doctor Kunal Saha seeking imprisonment of the Board of Directors of AMRI Hospital in Kolkata for their failure to pay the highest-ever compensation (at least Rs. 11 crore) in a case of medical negligence that caused the death of his wife in 1998 during a social visit to India.

On Oct 24 last the apex court delivered a historic judgment holding three top Kolkata doctors (Sukumar Mukherjee, Baidyanath Halder and Balaram Prasad) and AMRI Hospital guilty for causing death of Saha's wife and US-based child psychologist, Anuradha Saha, and directing AMRI Hospital to pay Rs. 6.08 crore plus interest at the rate of 6% from the date of filing of the case equaling to a total of more than Rs. 11 crore within a period of 8 weeks which ended on Dec. 19.

AMRI Hospital has failed to pay the compensation in blatant violation of the SC order and thus, have deliberately committed an act of contempt of the Supreme Court, said Saha.

"Ironically, a few days earlier, AMRI Hospital filed an application with a devious motive to avoid their responsibility by claiming that they need an extension of 1 year time to pay the compensation because they have been financially broken since 91 patients died at the same hospital from a devastating fire in 2011," said Saha.

The "contempt" petition is likely to come up for final hearing after the Apex Court opens following the Christmas vacation.

Saha had been fighting his case in various Indian courts since his wife's death and in the process started a patients' rights body to fight the healthcare frauds and medical negligence cases in India.
