The State Consumer Disputes Redressal Commission, Punjab has directed a nursing home in Ludhiana to pay Rs 50,000 as compensation for deficiency in services.
Stating this here today, an official spokesman said Mr Jeewan Chhibbar, a resident of Ludhiana, had filed the complaint that his wife Rajni Chhibbar was pregnant and had been getting treatment from Mittal Nursing Maternity, Ludhiana.
Due to some complications, doctors decided to conduct a delivery through caesarean on the expected date for which some documents were got signed from the complainant and his wife.
However, the doctors could not arrange anesthetist and pediatric doctors and the caesarean could not be performed.
The spokesman said the contention of the complainant was that the trauma could have ill effect on the foetus and the caesarean section was considered a safer alternative for delivery but the Mittal Nursing Maternity did not shift the patient to some other hospital despite knowing that without caesarean, the delivery was not possible and the life of the complainant's wife and child was in danger.
The child was born in severe critical condition and it was noticed that there was less supply of oxygen to the brain immediately before the birth of the baby causing severe damage to the brain. At that time the patient was shifted to Cheema Medical Complex, Mohali. The doctors said the child might survive but would be mentally retarded and physically handicapped.
He said due to the negligence of the nursing home, the mother had suffered mentally and physically and their child had become mentally retarded and physically handicapped due to the damage to the brain.
The Commission noted child died within a few days and it was the first child of the couple.
The spokesman said after hearing both the parties the Commission found negligence on the part of Mittal Nursing Maternity and ordered it to pay Rs 50,000 as compensation for deficiency in services.
