Andhra Pradesh Bar Counicl trying to establish separate Council for Telangana
Bar Council of Andhra Pradesh is making efforts with regard to the establishment of Bar Council of Telangana.
In the General Body meeting of Bar Council of Andhra Pradesh held last month, the issue of bifurcation of the Bar Council of Andhra Pradesh came up for consideration, AP Bar Council Chairman A Narasimha Reddy said in a statement here today.
After deliberations, The Bar Council decided to a constitute a nine-member sub-committee headed by A Narasimha Reddy (Chairman).
The Committee which met few days ago, after lengthy discussion on interpretation of relevant provisions under the Andhra Pradesh Re-Organization Act, Advocates Act, 1961 and the Bar Council of India Rules, the Sub-Committee felt that certain clarification are to be sought with the Council of India on the issue of constitution of new Bar Council for the state of Telangana, he said.
The Committee felt it necessary to go through the previous bifurcations of Bar Council of Bihar and Uttar Pradesh.
The Bar Council of India has also constituted a sub-Committee in this regard and hold a meeting with the Sub-Committee of the Bar Council of AP at its office in New Delhi, he said.
In the meeting, the representatives from Bar Council of Chhattisgarh and Uttar Pradesh also participated.
In the lengthy meeting, the Bar Council of India(BCI) also expressed its view that it may not be possible to commence a new Bar Council for the state of Telangana, since a separate High Court is not established.
But, Section 34(2) of A P Re-organisation Act make provision for the Advocates who are practicing before the High court of judicature at Hyderabad to avail their option of practice within one year from the date of establishment of High court of Andhra Pradesh and the High Court of Telangana as mentioned in Sec 31 of the Andhra Pradesh Re-Organisazation Act.
However, the General Body of Bar Council will meet within short period to take necessary steps, he added.
