The Haryana Cabinet today approved entrusting of approval work to committee of officers instead of an individual officer to check any misuse in issuing refunds to the dealers under the Haryana Value Added Tax Act 2003.


The cabinet met under the chairmanship of Chief Minister Bhupinder Singh Hooda here.

To check any misuse of power by an individual officer, a committee of officers has been constituted to approve refunds at the range and district levels on the pattern of the committee already constituted for approving refunds above Rs 25 lakh. For the refunds above Rs 25 lakh, a committee already stands constituted comprising of three senior most Additional Excise and Taxation Commissioners posted at the Headquarter. The Joint Excise and Taxation Commissioner would serve as Member Secretary. The senior most amongst these Additional Excise and Taxation Commissioners would be the Chairman.

The concerned Joint Excise and Taxation Commissioner (Range) would be the Chairman of the committee for refunds upto Rs 25 lakh and the other two members would comprise one of the senior most Deputy Excise and Taxation Commissioner posted in any district falling in the range (DETC may be from any wing that is ST or Excise or Inspection or PGT etc from any of the districts falling in the range) and the other the Deputy Excise and Taxation Commissioner (ST) of the district concerned. The Excise and Taxation Officer working as Nodal Officer (Refund) in the district concerned would work as Member Secretary.

For the refunds upto Rs ten lakh, the chairman of the committee would be Deputy Excise and Taxation Commissioner (ST) of the district concerned and the other two members would be two senior most Excise and Taxation Officers posted in the district (the ETOs may be from any wing that is ST or Excise or Inspection or PGT etc). The Excise and Taxation Officer working as Nodal Officer (Refund) in the district would work as Member Secretary.

At present, refunds above Rs 25 lakh are approved by a committee of three senior most Additional Excise and Taxation Commissioners posted in the Head Office. Refunds upto Rs 25 lakh are approved by the Joint Excise and Taxation Commissioner of the concerned range and upto Rs ten lakh are approved by Deputy Excise and Taxation Commissioner of the district concerned. The refunds upto Rs one lakh are sanctioned by the concerned Excise and Taxation Officer or the Assistant Excise and Taxation Officer.
