Terming the election of an Independent candidate Some Prakash Singh as illegal, the Patna High Court today set aside his election as an MLA from Obra Assembly constituency, held in 2010.

Justice Navnity Prasad Singh delivered the verdict after hearing the petition filed by JD(U) candidate Pramod Singh Chandravanshi.

In his verdict, the judge declared the election of Some Prakash as illegal.

The bench also directed the Election Commission to hold fresh election in Obra Assembly constituency as early as possible.

Challenging the election of Some Prakash, Mr Chandravanshi had stated that the resignation of Some Prakash was not accepted formally, when he was in Police department.

Despite this fact, his nomination was not cancelled and also later declared elected.

Through the petition, the JD(U) candidate also informed the court that Mr Prakash had filed his nomination on November 2,2010 and till then, his resignation was not accepted.

Even after several departmental actions pending against him, the Magadh range DIG completed the formalities within a day and accepted his resignation on November 3.

In the petition, it is said that the DIG is not a competent authority to accept the resignation of Mr Prakash, against whom several departmental actions were still pending.
