New Delhi, Aug 8 : A city court Friday ordered a man to double the monthly allowance he gives his 75-year-old widowed mother from Rs.500 to Rs.1,000 in view of the woman's medical needs.
Additional Sessions Judge Narottam Kaushal set aside Om Prakash's plea that increasing the monthly maintenance he gave his mother would be a financial burden on him as he has a large family.
“Sparing Rs.1,000 for your mother would not be a harsh liability on you, especially since she is more than 75 years of age and may not survive for long,” the judge said in his order.
”Dulari Devi is residing in her own house. The fact that she is old also suggests that over and above the minimum requirement of clothes and ration, she might also be needing some amount towards medical aid,” the order said.
The court modified the order passed by a metropolitan magistrate in January for providing Dulari Devi Rs.500 allowance on a petition filed by her under Section 125 of the Criminal Procedure Code.
In her revision petition, her counsel argued that Rs.500 per month is too small an amount for an old woman to survive on, especially when her son had an assured income of Rs.10,000 per month.
Her son, however, contended that he had two unmarried daughters and had financial limitations due to a large family to support.
The judge added that judicial notice could be taken that even for a person of the lower middle class, close to Rs.3,000-Rs.4,000 per month was a respectable amount with which to lead a decent life in old age.
