BCCI gets court go-ahead for meeting on Modi

New Delhi, Sep 24 : The Indian cricket board was Tuesday allowed by the Delhi High Court to hold its special general meeting (SGM) to consider a report on former IPL commissioner Lalit Modi's alleged financial lapses.

The high court set aside a trial court's order that imposed restrictions on the Board of Control for Cricket in India (BCCI) meeting scheduled for Sep 25.

Giving a go-ahead to the board, Justice V.K. Shali said: "So far as appeal of the BCCI is concerned, it is allowed."

The judge also dismissed Modi's cross-appeal against the decision of the trial court which had declined to pass an interim order on his plea challenging the appointment of Sanjay Patel as secretary and Jagmohan Dalmiya as the interim chief of the cricket board by N. Srinivasan.

Rejecting the arguments of Modi's lawyer who questioned the appointment of Dalmiya and Patel, the court said: "Srinivasan continues to be the president of the BCCI and he is also vested with some power to appoint them as functionaries of the board".

Challenging the trial court's Sep 21 order that restrained BCCI from holding its SGM, the board had moved the high court saying the trial court had no jurisdiction to pass such an order.

The trial court in an ex-parte order had restrained the board from holding its SGM on Modi's plea challenging Patel's authority as BCCI secretary in issuing the notice to him Sep 2 for considering the report of a three-member disciplinary committee comprising Arun Jaitley, Chirayu Amin and Jyotiraditya Scindia.
