Mumbai, Feb 12 : The Bombay High Court has quashed an order of Solapur Police Commissioner detaining a ration shop owner under the provisions of Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act for allegedly indulging in selling of blue kerosene in the black market.
The court passed the order recently after the owner challenged the detention order on the grounds that police had wrongly applied the provision as there was no evidence against him.
The court accepted the arguments and observed that the detention order was illegal because vital documents were not considered by the detaining authority while passing the impugned order.
