Kochi, Feb 4 : A Special Bench set up in Kerala for hearing cases relating offences against women in its first judgement acquitted the accused in a case here today.
The case was pertained to the rape of a woman who alleged that the incident took place in 1990 but the complaint was filed in 1997.
Special Bench Judge P Bhavadasn acquitted the accused stating that there was an unexplained delay in lodging the FIR and this gave a room for tampering and manipulating evidence.
There were no corroborative evidence other than the interested testimony of the prosecutors. The version of the witness and the evidence of the complainant could not be swallowed with a pinch of salt, judge observed.
The story was unbelievable and the accused is acquitted, said the Judge.
The accused was convicted for committing a rape with sentence of ten years imprisonment and a fine of Rs one lakh.
