HC rejects former minister's plea in massacre case

Ahmedabad, Jan 29 : The Gujarat High Court today rejected a group of petitions by former BJP minister Maya Kodnani and two others in connection with Naroda Gam massacre case of 2002 which claimed 11 lives during post-Godhra communal riots

While rejecting the petitions, Justice K M Thakar observed that there was no ground against the trial judge and her appointment was made by the Chief Justice of the High Court. Hence, there is no reason to transfer the case

In their petitions, Dr Kodnani, Babu Bajrangi and Kishan Korani, who are serving life sentence in Sabarmati Central Jail here, had sought the transfer of the trial of the case from the court of judge Jyotsana Yagnik, who awarded life imprisonment to them in Naroda Patia massacre case of 2002. Now, they are facing criminal trial in Naroda Gam massacre case

The petitioners argued that the trial should be transferred from Judge Yagnik's court to any other court on the ground that she has already formed an opinion on certain evidence which is identical in both the cases, which could prejudice their case in the Naroda Gam trial

As many as 11 people were killed in the Naroda Gam massacre and around 82 accused are undergoing trial in the case
