The Kerala High Court today quashed the FIR against the leader of Opposition in the Kerala Assembly and senior CPI(M) leader V S Achuthanandan in a case pertaining to the allocation of land to his relative and ex-service man in Kasargod district, allegedly flouting norms at the fag end of his tenure.
The allegation was that Mr Achuthanandan had conspired to allot land to one of his relatives.
The single bench judge Justice S Satheeshchandran observed that the Vigilance was misused by the man in power.
The allegation that all attempt was to tarnish the image of the petitioner cannot be brushed aside. The case was fixing the man on cross and searching for the nail, Justice Satheehchandran observed.
The offence under the Prevention of Corruption Act was not made out even as per the avernence in the FIR, the court observed.
The case against Achuthanandan pertains to alleged violation of norms while allotting 2.33 acres of land to T K Soman, an ex-serviceman and his relative, in Kasaragod district when he was Chief Minister, heading the previous LDF government.
