The Supreme Court today set aside the order of Madras High Court ordering the initiation of criminal proceedings against Tamil Nadu Chief Minister J Jayalalithaa for her involvement in an electoral violation case.
A bench comprising Justices H L Dattu and C K Prasad remanded back the petition to the high court for reconsideration.
Ms Jayalalithaa had filed nominations from four assembly constituencies in 2001, despite the fact that she stood disqualified from contesting elections in view of her conviction in Tansi land scam.
High Court in its order had held that there is prima facie evidence against Ms Jayalalithaa for her prosecution.
