Tamil Nadu was permitted to raise the water level of Mullaperiyar dam to 142 feet by the top court. Protests immediately ignited in the state of Kerala.


The judgement was delivered by a constitution bench comprising Chief Justice R M Lodha and Justices H L Dattu, C K Prasad, Madan B Lokur and M Y Iqbal.

Tamil Nadu had sought directions to the state of Kerala to allow it to raise the water level of Mullaperiyar dam to ensure adequate supply of water for irrigation to the farmers in TN.

State of Kerala had opposed it on the ground that raising of water level may lead to further damage to the base of the dam which had 'already outlived its sanctioned life and may lead to heavy loss of life and property in Kerala in case the dam gives way.'

The two south Indian states were locked in a fierce legal battle over the share of water in Mullaperiyar dam.
